Mabalacat City Vice-Mayor Noel Castro must face the music before the Office of the Ombudsman now that the complaint against him for alleged violation of Republic Act 3019 and violation of the Revised Penal Code has resurrected from the files of the anti-graft office.

To recall, a certain Noel Maglalang, a resident of Sitio Salazar in Barangay Bundagul, Mabalacat City, has filed a complaint against the vice mayor in November of last year before the Office of the Ombudsman for Luzon for violations of the Anti-Graft and Corrupt Practices Act and for Malversation of Public Funds.

If Maglalang’s allegations are accurate, his story reveals that Vice-Mayor Castro, who was then a Punong Barangay, acquired a 500-square meter lot at Sitio Talimundok from Joaquin Concepcion and his spouse. Prior to the acquisition, the owner of the land, through a notice, tried to eject the barangay from using the subject parcel of land as a basketball court.

Vice-Mayor Castro, who was the head of the barangay then, purchased the said lot from the owners to the tune of P115,000. The amount he used in buying the lot came from barangay funds, a witness to this is the then barangay treasurer Liza Cunanan.

In 2010, the sitting officials of the barangay sourced out funds for the development of the lot. A senator agreed to the barangay officials’ request with the condition that the lot is registered to the barangay. When the barangay officials sought for the documents of the lot, they were surprised that the same has been transferred to Vice-Mayor Castro’s name under a new land title, way back in April 2003. The land title of the previous owner has been cancelled in favor of Vice-Mayor Castro.

In an attempt to fix things up, Vice-Mayor Castro tried to donate the lot to Barangay Bundagul last May of 2012. With this act, he tried to fry the people of the barangay with their own lard. Should the cover-up has been made successful, the vice-mayor could have been even made a hero in the people’s mind due to his generosity of donating a lot in favor of the barangay.

Until its discovery, the people were so sure that the lot they are using as a basketball court and for other recreational and official activities was registered under the ownership of the barangay since the funds used in acquiring the same came from the barangay coffers.

The issue on the official ownership of the lot was discovered when the incumbent officials of the barangay solicited donations for the further improvement of the lot that they believed is named under the barangay.

A lawyer commented that if the Office of the Ombudsman will prove that Vice-Mayor Castro is guilty of the allegations against him, the latter may possibly face a six-year imprisonment and be disqualified from seeking public office. At present, he is a mayoralty candidate of Mabalacat city. If time would warrant the anti-graft office’s investigation, the vice-mayor need not campaign after all. The possibility of being disqualified is imminent.

On the above-said allegations of Maglalang, Vice-Mayor Castro cried foul and calls the allegations as political harassment. He proudly said that his conscience is clear. There might have been a shady deal during his incumbency as the village chief which gave him a controversy and such is haunting him now.
