CEBU City Medical Center (CCMC) credit officer Maria Lourdes Archua may have breathed a sigh of relief when the court upheld an order granting her an injunction to stop the special panel of the City Government from investigating her.

But Mayor Michael Rama wants the investigation to proceed over the loss of 28 Philhealth checks from CCMC early this year.

Rama has yet to receive the order issued by Regional Trial Court (RTC) Judge Gabriel Ingles last Dec. 2, which junked the motion for reconsideration filed by him and the members of the Special Administrative Investigation Committee (Saic).

But he said whether the City Attorney’s Office is out of the picture or not, the investigation against Archua must go on.

“Kung naay basis ang pagpadayon sa investigation, ipadayon gyud na, nganong dili man? Kinsa naman lang diay mutubag sa accusation (Who will answer the accusations if we stop the investigation)?” Rama asked.

Judge Ingles agreed the matter should be investigated as it involves public money. But he clarified the constitutional right to due process shouldn’t be sacrificed.

Ingles said with the presence of members of the City Legal Office as prosecutor and judge, there is already bias, as earlier claimed by Archua.

Saic, which was tasked by Rama to investigate Archua, is composed of lawyers from the City Legal Office except for City administrator Jose Marie Poblete.

They are Carlo Vincent Gimena (presiding officer), Dominic Dinio (liaison officer), Ferdinand Cañete and Lecel Llamedo. City Attorney Joseph Bernaldez and Marie Velle Abella reportedly acted as prosecutors during the special hearings.

One option for Rama is to create another panel of investigators, or he may ask the Human Resource Development Office (HRDO) to continue the inquiry.

Rama, however, said he will talk first to Bernaldez today to ask for guidance on what to do about the decision of the court.

In a separate interview, Bernaldez said he hasn’t received and read the decision yet, though, he heard about it last week.

He will ask for a copy of the resolution today from Gimena so he can brief the mayor
about their options.

“Ato sang tan-awon ang disisyon sa korte kung unsa ang context kay wa pa man ko makadawat ug kopya gud (I will look at the court decision first),” Bernaldez said.

Archua was suspended for 30 days last July for her involvement in the loss of 28 Philhealth checks of CCMC amounting to P240,000.

She filed a petition for preliminary injunction after she found partiality in the special hearings conducted against her.

Ingles granted the request of Archua, prompting the investigating body to file a
motion for reconsideration, but it was also junked by the court.
