Massacre victims seek reparation, eye Ampatuan frozen assets

FAMILIES of media workers killed in the worst incident of election-related violence in the country has asked a Manila court to set aside a billion pesos from the frozen assets of the clan that reportedly planned the massacre.
Once set aside, the money will be used for their reparations after their loved ones were killed in the gruesome Maguindanao massacre, the group’s lawyer said in a seven-page suit submitted to the court.
The petition also asked the court to allow the victims’ families to intervene in a separate case that attempts to forfeit the Ampatuan clan’s assets in favor of the government.
The group represented by UP Law Professor Harry Roque said that they are entitled to assets of the Ampatuan clan, members of whom reportedly planned and implemented what is now known as the Maguindanao massacre.
The group seeks to preserve at least P1-billion from the frozen assets and bank accounts of the Ampatuans, saying that they are entitled to reparations as victims of human rights violations.
“The acts committed in the slaughter of civilians by State agents belong to this class of gross human rights violations for which the State must answer. Moreover, the Republic also has a duty to provide compensation and satisfaction to the victims and their families under international law. The massacre perpetrated by state agents violated the duty of the Philippine State not to provide impunity,” Roque said, noting that the Ampatuans, then still in power, made use of government agencies such as the police, in committing the carnage.
Earlier, the Office of the Solicitor General filed the forfeiture case in behalf of the Anti-Money Laundering Council (AMLC) against the Ampatuans, led by its patriarch, detained former Maguindanao Gov. Andal Ampatuan Sr.
Last December 2, the government was able to secure a preliminary asset preservation order (PAPO) from the Manila RTC on the same day that they filed the civil forfeiture case.
The case was filed to prevent attempts of the Ampatuans to withdraw or transfer from their bank accounts previously covered by a freeze order of the Court of Appeals.
Last week, a member of the Ampatuan clan attempted to withdraw from one of the accounts covered by the freeze order in a Banco de Oro branch in Cotabato.
The Ampatuans were tagged in the November 23, 2009 massacre of 57 individuals, among them members of the rival Mangudadatu clan, their lawyers and supporters, and some 30 journalists who accompanied their convoy to a local Election office.
After criminal cases were filed against them, AMLC applied for and successfully secured a freeze order on their assets at the CA.
