Chief Justice rules out going on leave
CHIEF Justice Renato Corona has ruled out taking a leave of absence from the Supreme Court (SC) despite facing an impeachment trial at the Senate.
SC spokesman Midas Marquez announced this Wednesday after various sectors, including some congressmen, have asked him to go on leave.
Corona has chosen to continue performing his duties at the High Court even as he prepares for an impeachment trial, Marquez said.
“There is nothing in the constitution or any law that requires him (Chief Justice) to leave his office while facing impeachment proceedings. So he will continue to perform his functions,” stressed Marquez.
Marquez made this statement after Marikina Representative Miro Quimbo, spokesperson of the House of Representatives prosecution panel, said going on leave pending the Senate trial is the decent thing to do for Corona.
By going on leave, Corona would not involve the entire SC, including Marquez, Quimbo said.
But according to Marquez, he is just performing as expected being the High Court’s spokesman.
“Let me repeat. It’s my function to protect and defend the institution and the justices, including the Chief Justice. For as long as he (Corona) is the Chief Justice, I will speak for him the same way I can speak for the other justices,” he explained.
At the same time, Marquez also said that the Malacanang’s move to find a possible replacement for Corona is simply “too presumptuous” and “too arrogant”.
“There’s no vacancy to speak of. It is clear in the constitution that the selection process – if there will be any – is the mandate of the JBC (Judicial and Bar Council),” said Marquez.
“Let’s not be too presumptuous. Let’s not be too arrogant. Perhaps it would help it we exercise even a little humility,” he added.
Earlier this week, presidential spokesman Edwin Lacierda said the President has already asked his legal advisers to come up with a list of possible nominees for chief justice. (AMN/Sunnex)
