Chief Justice ‘intends’ to prolong trial until 2013 polls

A LAWMAKER-complainant in the impeachment case against Supreme Court (SC) Chief Justice Renato Corona thinks the respondent is resorting to delaying tactics intended to prolong the trial until the 2013 midterm elections.
Eastern Samar Representative Ben Evardone said Friday that based on Corona’s answer to the articles of impeachment filed early this week, “the Chief Justice has raised the issue of propriety of verification as a preliminary matter.”
“This means that the Senate may have to receive evidence on the issue of verification before it proceeds to try on the more important allegations in the Articles of Impeachment,” the lawmaker explained.
“Even before going into the merits of the case, the impeachment trial of Chief Justice Corona could be rendered functus officio or lapsed if made to continue until the elections of 2013,” he added.
But Corona said moves to impeach him was done “like a thief in the night” at the House of Representatives.
The 188 lawmakers signed a House resolution impeaching the Chief Justice on December 12 during a majority caucus. The signing was completed in a matter of hours after a presentation on the grounds of the case was presented to them.
Evardone said should the Senate decide to first determine the issue of verification before going into the merits of the impeachment case, each of the 188 congressmen-signatories might be put to stand to state whether or not they have read the House resolution impeaching Corona.
This, he said, would eat up roughly 188 trial days or more than six months, including weekends and holidays.
“If that happens, the power of the Senate, as an impeachment court, could lapse since the respective terms of office of the prosecutors Congressmen, and 12 of the senators will end,” Evardone said.
On the other hand, Evardone noted that should the Senate proceed immediately with the substance of the case, Corona might file a petition for certiorari and/or in junction before the SC on grounds that the impeachment court gravely abused its discretion when it failed to hear on the preliminary issue of verification.
The lawmaker argued that the propriety of verification is a non-issue since the issue can only be applied when a complaint is filed and in this case, what the 188 lawmakers filed was a resolution of impeachment.
He added that “under the Constitution, the resolution of impeachment is conclusively presumed verified with the signature of at least one-third of members of the House of Representatives filing it.”
