Pampanga to enact Environment Code
CITY OF SAN FERNANDO–The Sangguniang Panlalawigan is set to approve the first-ever streamlined, consolidated and comprehensive Provincial Environment Code shortly after the stakeholders made a thorough review on its provisions.
During the hearing, Engr. Arthur Punsalan, Provincial Environment and Natural Resources Office head, said that the provincial environment code is “encompassing.”
“The proposed environment code is comprehensive and encompassing as it covers air, water, land resources use and all aspects of environmental management,” Punsalan added.
According to Fourth District Board Member Nestor Tolentino, after the last hearing scheduled on December 28 this year, the board will set its second and final reading for its approval which includes passing of the necessary ordinance and implementing rules and regulations.
“Hopefully by the first week of January 2013, the ordinance will be ready for enactment,” Tolentino said.
The code, he added, is centralized around the “powers of the governor and Capitol,” and was created based on existing environment and other laws as its backbone.
“Our environment code took into consideration many existing laws like republic acts on solid waste management, wildlife resources conservation, toxic substances, small-scale mining, protection of caves and cave resources, Philippine Fisheries Code, Local Government Code, Water Code, Anti-Illegal Logging, coastal management, environmental impact system and even our local tax ordinances on quarrying to name a few.
Also, the members of the technical working group are representative of all stakeholders involved as environmental management, protection and preservation is everyone’s concern,” Tolentino furthered.
The two public hearings, he added, are meant to draw more suggestions or recommendations from other stakeholders and experts from the Department of Agriculture, Department of Public Works and Highways, Bureau of Fisheries and local government officials.
“We want to involve everyone in this very critical code on our environment so we can further streamline it and customize it for the province’s needs, so much so that local government units without an environmental code could adopt it or use it as a parallel law. What is important here is to regulate and implement laws ‘with teeth’ to manage our environmental resources,” Tolentino stressed.
Punsalan, for his part, noted that a proposed provincial environmental clearance certificate or PECC acquisition facility is included in the code.
“That will be a first if approved. Industries or players in the industry will have to secure a PECC from Capitol because we really want to regulate everything when it comes to the environment. We will be able to gain headway with the approval and implementation of the environment code. We are optimistic about this,” Punsalan ended.
Others who attended the hearing were representatives from various government agencies like the Environmental Management Bureau of the Department of Environment and Natural Resources Office, Board Members Melchor Pingol, Salvador Dimson, Jr., Monina Laus and environmentalist Cecille Yumul from Save the Trees Coalition.
