Palace defends move to look for Chief Justice’s replacement

MALACANANG defended Thursday its move to look for the Supreme Court Chief Justice’s replacement, saying the act is not arrogance.
A Palace official made these remarks a day after a Supreme Court spokesperson said that Malacanang’s move to come up with a shortlist of Chief Justice Renato Corona’s replacements is “part of a contingency plan.”
“We don’t think it’s arrogant to have a contingency plan,” deputy presidential spokesperson Abigail Valte said, adding it is not the first time that the Executive is scouting for a possible replacement for a position that has yet to be vacated
“Allow us to remind Atty. [Midas] Marquez that in 2010, even before the post was vacated by the former Chief Justice (Reynato) Puno, they were already looking for replacements. The JBC (Judicial and Bar Council) already convened even before there was a vacancy,” she related.
Previously, Marquez asked Malacanang not to be “too presumptuous and too arrogant” after he learned that President Benigno Aquino III has instructed legal advisers to come up with a list of possible nominees for Corona, who is facing an impeachment trial in January.
Marquez also stressed that the Chief Justice post is not yet vacant as the impeachment trial will only start next month. Only the Judicial and Bar Council, and not Malacanang, has the authority to screen possible applicants to the judiciary, he added.
“The scouting does not mean that we supplanting the functions of the JBC… On the contrary, that is a normal practice of a government to prepare for options and then you wait for the shortlist from the JBC…Of course, you also expect us to do our homework,” Valte said in reaction to Marquez.
Under the Constitution, the JBC “shall have the principal function of recommending appointees to the judiciary.” It also says that the members of the Supreme Court and judges of the lower courts shall be appointed by the President from a list of at least three nominees prepared by the Judicial and Bar Council for every vacancy. Such appointments need no confirmation.
Unlike in the previous administration, Valte said the Aquino government will honor the shortlist that the JBC will submit even if the nominees do not favor Aquino.
“Even in appointments in lower courts, hindi po kami nagbabalik ng listahan, sinusunod po namin. ‘Yun po ‘yung nasa batas, ang listahan po ay kailangang manggaling sa JBC—it’s a shortlist of three for every position—sinusunod po ng Pangulong Aquino,” she said.
“Ang hinahanap po natin ay hindi ‘yung pabor sa Pangulong Aquino. Ang gusto lang po natin ay maging patas at naaayon sa mandato ‘yung dapat ginagawa,” she added.
Asked if what will be the contingency of the government in case the impeachment court decides to acquit Corona, Valte said “it’s premature at this point to talk about decisions yet… Maybe going further we will be able to have a better idea of how the trial will go.”
