Palace distances itself from suspended presidential adviser
MALACANANG on Wednesday distanced itself from presidential adviser on environmental concerns Nereus Acosta, who has been ordered suspended by an anti-graft court owing to three pending graft charges.
Since the cases were filed prior to Acosta’s appointment to a government office, the Palace will let him defend himself before the Sandiganbayan, presidential spokesperson Edwin Lacierda said.
“Since it’s already a legal issue, we‘ll leave it to their lawyers to defend the respective individuals….We believe that the lawyers of Mr. Acosta are fully capable of defending him,” Lacierda said.
On Tuesday, Acosta, who lost as a Senate bet under Aquino’s Liberal Party during the May 2010 polls, asked the Sandiganbayan Fourth Division to junk a motion seeking his suspension from office.
In his motion, Acosta said he cannot be suspended since he is a presidential appointee and that his position is beyond the jurisdiction of the Sandiganbayan.
His appointment “is a political act which is beyond the power of courts to rule upon, interfere with, or adjudicate against. The appointment of the accused is a political question that is non-justiciable and which this Honorable Court cannot pass judgment on,” Acosta said in his motion.
Lacierda also said that he has yet to ask President Benigno Aquino III and Acosta regarding the matter.
He, meanwhile, noted that Acosta’s job will not be compromised should he will be suspended by the graft court. “We have other officials who will take care of the environment,” Lacierda said. (Jill Beltran/Sunnex)
