Palace asks SC to keep distance in Corona’s impeachment

MALACAÑANG asked Thursdya the Supreme Court to distance itself from the impeachment trial against Chief Justice Renato Corona.
“It will be more proper for the Supreme Court (SC) to let the process take its course because if it’s going to stop the process then that would mean a biased position in favor of one of its own members,” Presidential spokesperson Edwin Lacierda said.
Four petitioners so far have asked the High Court to stop the proceedings on the impeachment of Corona in the Senate, including Marcos loyalist and lawyer Oliver Lozano.
The other three are lawyer and former Integrated Bar of the Philippines (IBP) national president Vicente Millora, another lawyer Vladimir Cabigao, and Danilo Lihaylihay, who also filed a plunder case against former President Gloria Macagapal Arroyo.
Since the articles of impeachment have been transmitted to the Senate, the trial is now beyond the purview of the SC, Lacierda said.
“Now, it becomes a political issue or a political question as what we say in the legal community and, therefore, it is now up to the representatives of the people to decide the fate of the Chief Justice,” he said.
The Senate is set to tackle the impeachment case against Corona in January next year.
Lacierda dismissed the statement of the IBP that the executive and the legislative would be violating the Constitution for pushing the impeachment since it is supposedly “railroaded”.
“I don’t think it’s proper for the IBP to accuse the executive branch or the legislature of railroading a process which was mandated by the Constitution. The process, again, is provided for under the Constitution so I think the IBP should very well recognize that there is a mechanism such as impeachment in a removal for a sitting justice,” he said.
“What we question is the independence of the judiciary. Again, this is not about an attack on the institution itself. This is about strengthening the institution,” he added.
As a member of the IBP, Lacierda said the stand of the leadership does not reflect the position of all of its members.
“I am a member of the IBP and the stand of the IBP does not reflect my position,” he said.
Should the SC act on the petition against Corona’s impeachment, Lacierda said it is up for the Senate to decide on what course of action to take.
Lacierda, meanwhile, downplayed the statement of Senator Edgardo Angara that Corona’s impeachment would turn off foreign investors next year.
He reiterated that the purpose of the impeachment is to have an SC that is “consistent” and “impartial”.
“What we want is an independent Supreme Court — that’s what the President always wanted and has always advocated. We hope that this exercise of impeachment would also tell what we have been saying all along to the Filipino people that the executive branch and the legislative branch are all accountable to the Filipino people,” Lacierda said.
