Senator to colleagues: Consider out of court settlement

THE Senate, acting as an impeachment court, should consider settling the case against Chief Justice Renato Corona, and with it, the rift between the Supreme Court and Malacañang, a senator said Thursday.
“As judges of the impeachment court, we are tasked not only to try the accused, but also to find a middle ground and see if we can settle the issue more amicably out of court,” Senator Edgardo Angara, a veteran lawyer and lawmaker, said in a press statement.
He said the Senate ought to explore mediation between the two branches of government “so the entire country will not have to be caught up in the dispute between the President and the Chief Justice.”
Senate President Juan Ponce Enrile said last week that the Senate should not interfere in the brewing clash between Malacanang and the Supreme Court.
He said Wednesday that “we have to accept that there is an adversarial position between the two branches.”
Angara also called for calm as the Senate prepares to hold the impeachment trial in January.
“The emotions are very high. It is important that we maintain a sense of calm and try to tackle the issue rationally. And we should strive to protect the morale and working relationships of employees throughout the bureaucracy,” he said.
Senator Antonio Trillanes IV, who walked out of his trial in 2007 to hole up at a hotel and call for a change of government, meanwhile, said impeached Chief Justice Renato Corona cannot be faulted for his acerbic speech against the President on Wednesday.
“If I were him, I would probably do the same thing,” he told reporters.
He said Corona made his case before the public, as President Benigno Aquino III has also done it. Like Aquino, who has declared support for the impeachment, Corona “needs to convince people that he is in the right,” Trillanes said.
He said the impeachment trial is a political exercise and public sentiment has bearing on how senators, sitting as an impeachment court, will vote on the articles of impeachment.
Trillanes said while Corona cannot be faulted for hitting back at the President in public, Malacañang is also free to issue its own statements. “If they choose to squabble, that is their right.”
Senators swore on Wednesday afternoon to “do impartial justice according to the Constitution and laws of the Philippines.”
Corona told supporters gathered at the Supreme Court on Wednesday that he is opposing a “dictatorship” that President Aquino is trying to create. He said he was impeached to make sure the Supreme Court will be subservient to Malacañang.
Summons for Corona out
The Senate is expected to send Corona summons to appear at his impeachment trial when it convenes in January.
Lawyer Valentina Cruz, impeachment court spokesperson, said the summons will be brought to Corona at the Supreme Court so the Chief Justice can receive it himself.
According to Rule 7 of the Rules of Procedure on Impeachment Trials adopted by the Senate, “if personal service cannot be done, service of the writ may be made by leaving a copy with a person of sufficient age and discretion.”
Corona will be given 10 calendar days to respond to the summons, and the House of Representatives prosecution panel will be given five days after receipt of his response to reply. The trial will commence on January 16 next year.
Corona may choose not to attend the trial. The rules allow him to send his counsel, or nobody at all. Under Rule 9, “if he does not appear, either personally, or by agent or counsel, the same shall be recorded.”
The Chief Justice, impeached by the House on Monday evening, has said he is innocent of graft, violations of the Constitution, and betrayal of the public trust.
