High Court allows pipeline operations

THE Supreme Court has lifted an order that allowed a Manila-Batangas pipeline to run for two days so that it can be tested for leaks.
The High Court, as a whole, granted the urgent motion of the First Philippine Industrial Corp. (FPIC) to lift the temporary environment protection order (Tepo) that stopped the pipeline’s operations.

The Lopez-led FPIC manages the 117-kilometer Batangas to Manila pipeline, which is used to bring more than 50 percent of the Philippine capital’s petroleum products to the Pandacan depot. The depot supplies fuel to 459 gas stations in Metro Manila and about 1,800 gas stations in Regions 1 to 4.
In an en banc resolution, the High Court said it was lifting the Tepo “for the duration of not more than 48 hours from the start of the proposed test runs and only for the duration of said tests in order for FPIC to conduct the tests for purposes of checking the integrity of the white oil pipeline (WOPL).”
The Tepo was lifted after various government agencies and academic bodies unanimously recommended leak tests for the pipeline.
The University of the Philippines National Institute of Geological Sciences (UP-NIGS), the UP Institute of Civil Engineering (UPICE), and the Department of Energy (DOE) submitted a joint manifestation endorsing the leak tests.
Earlier on April 15, 2011, the SC conducted an ocular inspection with the DOE, UP-NIGS and UPICE that proved there were no additional leaks in the white oil pipeline (WOPL) of the FPIC.
The SC issued the writ of kalikasan after FPIC discovered that it was the WOPL which was the source of oil that had been leaking into the basement of a 22-storey Makati condominium on July 12, 2010.
On October 29, 2010, geologists from the University of the Philippines discovered the source of the leak, the FPIC’s 40-year-old pipeline.
As of August 14, a total of 22 trucks were able to haul a total of 440,000 liters of liquid from the basement.(AH/Sunnex)
